Subtipo: DECRETO ORDINARIO El Presidente de la Rep·blica de Colombia, en uso de sus facultades constitucionales y legales, en especial las que le confiere el numeral 25 del artĒculo 189 de la Constituci¾n PolĒtica, con sujeci¾n a las normas generales de las Leyes 6║ de 1971, 48 de 1983 y 7║ de 1991, y oĒdo el concepto del Comitķ de Asuntos Aduaneros, Arancelarios y de Comercio Exterior, yĀ ĀĀ

CONSIDERANDO:

Ā ĀĀ Que la Ley 6║ de 1971 establece las normas generales a que debe someterse el Gobierno Nacional al modificar el Arancel de Aduanas cuando se trate, entre otros aspectos, de la actualizaci¾n de la Nomenclatura, sus Reglas de Interpretaci¾n y Notas Legales, asĒ como de la reestructuraci¾n de los desdoblamientos;Ā ĀĀ Que la Ley 48 de 1983 cre¾ el Certificado de Reembolso Tributario -CERT- como un instrumento flexible de apoyo a las exportaciones cuyos niveles fijarß el Gobierno Nacional en cualquier momento, de acuerdo con los productos y las condiciones de los mercados a que se exporten;Ā ĀĀ Que la Ley 7║ de 1991 establece que el Certificado de Reembolso Tributario es un instrumento flexible, cuyos niveles serßn determinados por el Gobierno Nacional, de acuerdo con los productos y las condiciones de los mercados a los cuales se exporten, en consonancia con las polĒticas monetaria, fiscal, cambiaria y arancelaria;Ā ĀĀ Que el artĒculo 1║ del Decreto 33 de 2001, estableci¾ los niveles porcentuales del Certificado de Reembolso Tributario -CERT- para las exportaciones de los productos que se clasifican por los capĒtulos, partidas y subpartidas del Arancel de Aduanas, que se embarquen a partir de la fecha de entrada en vigencia del citado Decreto;Ā ĀĀ Que mediante el Decreto 2800 de 2001, modificado por los Decretos 618 y 1019 de 2002, se expidi¾ el nuevo Arancel de Aduanas para dar cumplimiento de la Decisi¾n 507 de la Comisi¾n de la Comunidad Andina, que adopt¾ en la Nomenclatura Nandina, la Tercera Recomendaci¾n de Enmienda al Sistema Armonizado, que entr¾ a regir el 1║ de enero de 2002;Ā ĀĀ Que el nuevo Arancel de Aduanas modific¾ la nomenclatura arancelaria de algunos productos cobijados en el Decreto 33 de 2001 que fija los niveles porcentuales del Certificado de Reembolso Tributario -CERT-, por lo que se hace necesario establecer su correspondencia con la nueva clasificaci¾n arancelaria;Ā ĀĀ Que el Comitķ de Asuntos Aduaneros, Arancelarios y de Comercio Exterior, en su sesi¾n de noviembre 25 de 2002, seg·n Acta n·mero 94, aprob¾ la actualizaci¾n de las subpartidas arancelarias contenidas en el Decreto 33 de 2001, modificadas o desdobladas por los Decretos 2800 de 2001, 618 y 1019 de 2002;Ā ĀĀ Que mediante el Decreto 1989 del 6 de septiembre de 2002 estableci¾ que las exportaciones que. se embarquen a partir de la entrada en vigencia del presente decreto tendrßn cero como nivel porcentual del Certificado de Reembolso Tributario;Ā ĀĀ Que el Decreto 1989 del 6 de septiembre de 2002 fij¾ en cero el nivel porcentual del Certificado de Reembolso Tributario -CERT- para las exportaciones que se embarquen a partir de su entrada en vigencia, ocurrida el 6 de septiembre de 2002,Ā ĀĀ

ArtĒculo 1░. La subpartida arancelaria 21.06.90.99.00, tendrß derecho al nivel porcentual de CERT previsto en el Decreto 33 de 2001 para la subpartida 21.06.90.90.10, ·nicamente cuando se trate de preparados alimenticios destinados a sustituir totalmente la alimentaci¾n humana ordinaria, no expresados ni comprendidos en otras partidas.Ā ĀĀ ArtĒculo 8║. La subpartida 29.39.11.10.00 tendrß el nivel de CERT previsto en el Decreto 33 de 2001 para la subpartida 13.02.11.00.00.Ā ĀĀ ArtĒculo 9║. Los productos clasificables en la subpartida 30.06.80.00.00, que corresponden con lo establecido en la Nota Legal 4 literal k) del capĒtulo 30, asĒ como los clasificables en la subpartida 38.25.30.00.00, que corresponden con lo establecido en la Nota Legal 6 literal a) del capĒtulo 38, tendrßn derecho al nivel porcentual de CERT previsto en el Decreto 33 de 2001, para los respectivos capĒtulos del Arancel de Aduanas.Ā ĀĀ ArtĒculo 10. Los productos clasificables por la subpartida 38.22.00.30.00, que corresponden con lo establecido en la Nota Legal 2 literal a) del capĒtulo 38, tendrßn derecho al nivel porcentual de CERT previsto en el Decreto 33 de 2001, para los respectivos capĒtulos del Arancel de Aduanas.Ā ĀĀ Los productos de la partida 38.25, que corresponden con lo establecido en la Nota Legal 6 literales b), c) y d) del capĒtulo 38, tendrßn derecho al nivel porcentual de CERT previsto para la partida 38.24 en el Decreto 33 de 2001.Ā ĀĀ ArtĒculo 11. Los capĒtulos 4, 24, 28, 31, 32, 34, 35, 37, 40, 46, 48, 54, 56, 57, 58, 59, 66, 67, 69, 70, 73, 82, 83, 84, 85, 86, 87, 88, 89, 90, 91, 92 y 95, que fueron modificados en su nomenclatura por los Decretos 2800 de 2001, 618 y 1019 de 2002, no se incluyeron en el artĒculo 1║ del presente decreto, debido a que el Decreto 33 de 2001 le asigna el mismo nivel porcentual de CERT a todas las subpartidas contenidas en cada uno de ellos.Ā ĀĀ Los capĒtulos 2, 26, 47, 75, 81, 93, 97, 98 y las subpartidas contenidas en otros capĒtulos, cuyo nivel porcentual de CERT seg·n el Decreto 33 de 2001 es cero (0), no fueron incluidos en el artĒculo 1║ del presente decreto.Ā ĀĀ ArtĒculo 12. Los productos que hayan pasado de un capĒtulo a otro mantendrßn el mismo nivel porcentual de CERT, seg·n el Decreto 33 de 2001, siempre y cuando, este nivel sea igual para los dos capĒtulos.Ā ĀĀ ArtĒculo 13.
